GUARANTEE AGREEMENT

1. Why this agreement is made

  1. The Guarantor has asked the Landlord to grant the Tenancy to the Tenant. In return for the Landlord doing so, the Guarantor makes the promises in this agreement.
  2. The Guarantor confirms they have been given a copy of the tenancy agreement and have had the opportunity to read it, and to take independent legal advice, before signing.

2. What the Guarantor promises

  1. If the Tenant does not pay the rent, or any other sum they owe the Landlord under the Tenancy, when it is due, the Guarantor will pay it to the Landlord within 14 days of receiving a written demand.
  2. If the Tenant breaks any of their obligations under the Tenancy, the Guarantor will pay the Landlord the reasonable cost of putting things right, and any loss the Landlord suffers as a direct result, within 14 days of receiving a written demand showing how it has been calculated.
  3. The Landlord must first ask the Tenant to pay. The Landlord may then make a demand on the Guarantor without having to take court action against the Tenant.

3. How long it lasts and the limit

  1. This guarantee covers the Tenancy for as long as it continues, including any rent increase made lawfully under the Tenancy or the Housing Act 1988.
  2. The Guarantor's total liability under this agreement will not exceed the Maximum liability shown above.
  3. This guarantee does not cover any new tenancy the Tenant takes of the Property or anywhere else, unless the Guarantor signs a new guarantee for it.
  4. The Guarantor's liability ends when the Tenancy ends and every sum due under it has been paid or settled. The deposit will be applied to any sums due before a demand is made on the Guarantor for them.
  5. The Landlord giving the Tenant extra time to pay, or not enforcing a term straight away, does not release the Guarantor.

4. Keeping the Guarantor informed

  1. The Landlord will tell the Guarantor in writing, within 14 days, if the Tenant falls more than one month behind with the rent, so that the Guarantor is not faced with a larger sum later without warning.
  2. Notices and demands may be sent to the Guarantor at the address or email address above, or any new address the Guarantor gives the Landlord in writing. The Guarantor will tell the Landlord promptly if their address changes.

5. General

  1. This agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
  2. The Guarantor's personal data is used only to administer this guarantee and the Tenancy, in line with the Landlord's privacy notice.
Signing this agreement is a serious commitment: if the Tenant does not pay, you can be asked to pay up to the Maximum liability shown above. If you are unsure, take independent legal advice before signing.
